By accessing or using the PrizMed Imaging API platform ("Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms.
PrizMed provides a cloud-based API platform for medical imaging data streaming, processing, and management. The Service includes the PrizMed API, client SDKs, documentation, and associated infrastructure.
You must register for an account to use the Service. You are responsible for maintaining the security of your API keys and account credentials. You must notify us immediately of any unauthorized access.
You agree to use the Service in compliance with all applicable laws, including HIPAA, HITECH, and applicable state privacy laws. You shall not: (a) use the Service for any unlawful purpose, (b) attempt to reverse-engineer the Service, (c) exceed your plan's rate limits without authorization, or (d) transmit malware or malicious content through the API.
PrizMed provides a 99.9% uptime SLA for Professional plans and 99.99% for Enterprise plans. Downtime credits are calculated as described in your service agreement. Scheduled maintenance windows are excluded from SLA calculations.
Paid plans are billed monthly or annually as selected. Fees are non-refundable except as required by law or as specified in your enterprise agreement. We reserve the right to change pricing with 30 days' written notice.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRIZMED'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL PRIZMED BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.
These Terms are governed by the laws of the Commonwealth of Massachusetts without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Boston, Massachusetts.
